    Question: My mom died when i was 7 years old and i was adopted at the age of 17 months when my mom died my grandparents started up a legal child custody suit to take me from my dad can they do this they are my moms mother and father

    Answer:

    Grandparents generally feel very strongly about the chance to spend time with their grandchildren, and stay involved in their lives as they grow up. However, biological and adoptive parents generally have the constitutional right to direct a child's upbringing. Your grandparents would need to file a  petition in superior court and prove that you living with your dad is deterimental (will hurt) you. . A.R.S. § 25-415 is the Arizona law explaining non-parental custody requests..

    Remember, the most important consideration for the judge will be what is in the child's best interest..
