Question: I have been charged with a class 3 felony for trafficking stolen goods, what is the penalty for this?
Answer: The answer to this question really depends upon whether this is your first offense or not. In Arizona, we have mandatory sentencing for each class of felony. However, the sentencing or penalty varies depending upon the number of offenses you committed before. The sentencing range or penalty could range from 2-5 years in prison. However, if this is your first offense, then you are probation eligible. This means that the court would probably not give you any prison time and instead give you probation. The number of years probation a judge could give for a class 3 felony is up to 5 years. The sentencing range for first time offenders usually becomes relevant if you are placed on probation and you violate your probation. Then the judge will send you to prison for anywhere from the minimum sentence for a class 3 to the maximum.
In addition, you must be aware that for any term of probation on any crime, a judge could first make you serve up to one year in the county jail. Now if you already have a prior felony conviction, then the penalty for a class 3 felony is higher and you are no longer eligible for probation.
