    Question: What is the penalty for assault and battery?

    Answer: The laws are different in every state, but are basically a crime. Punishment usually depends on how serious it was, if a weapon was involved, was the victim physically injured, etc. In many states a juvenile accused of assault can (or must) be tried as an adult. Penalties include jail, prison, probation, fines, restitution, community service and counseling. The Judge considers the age of the person, their record and the seriousness of the crime.

    My 11 year old daughter was being bullied by two girls, on of the girls threatened to punched her in the face and came at her. So my daughter punched the girl breaking her glasses. the mother is pressing charges (assault 2nd degree/battery). How could this be right? They've picked on her months and she was defending herself. what can i do to protect her from scaring her record she has great grades and wants to go to college.

    I am about to get charged with the same thing next week, I just got the letter today in the mail, and I don't know what is going to happen, my mom in a cop,and she is tellin me that if the judge decides that I am guilty of assault and Battery then I could face up to 1 or more years in jail/prision, because Assault and Battery is a Felony unless you ask the judge to do some other things to get the Felony off your record.

Then he swung a bat at me, i ducked he missed so i tackled him to the ground braking his wrist and a rib and giving him a bloody nose.
