Question: I was born out of wedlock and have my mom's last name. Can I stop my dad from changing my last name to his?

Answer: In Arizona a parent may file an application with the court to change a minor's name. He will probably have to give notice of his application to you and to your mother (send you a copy of the pleading, possibly even serve it on you). If your mother objects, the court will hold a hearing to determine whether it is in your best interest to have your name changed. It is likely that the court would interview you to find out what you think about it any why. Your mother will have to act by objecting (filing a document telling the court that she doesn't want the court the grant the name change. This is because you are a minor.

Do what you have to do if feel really strong about this. Don't let your parents decide things for you. If they can't respect your decision then you should take matters into your own hands.

I don't think it is wise to change your surname for any reason unless your life is in danger. legal name changes are very serious and could lead to all sorts of ID difficulties later in life. My mother tried to make my brother and myself use the last name of her second husband after she divorced my dad. This proved to be of zero benefit to us children except to cause confusion and mistrust for her motives were based on hatred for my father - not substantial gain for us kids.
