    Question: What happens when a person gets caught driving and their license has already been suspended or revoked for something like a DUI?

    Answer: The law addresses this scenario in Arizona Revised Statutes 28-3473 which says that a person caught driving with a license suspended or revoked for DUI is guilty of a class 1 misdemeanor. Punishment is a mandatory minimum 48 hours in jail, which could certainly result in the judge ordering more time since only a minimum is specified in the law.

    If a person's license is suspended or revoked by the Department of Motor Vehicles as the result of a DUI conviction, the person's terms of conviction will usually contain restrictions on driving as well, so getting caught driving on a suspended or revoked license will almost always result in a violation of the person's probation and may lead to re-sentencing on the original DUI charge.

    Additionally, the law provides that if a person is caught driving on a suspended or revoked license, their vehicle may be impounded as set forth in Arizona Revised Statutes 28-3511.

    My husband got arrested the other day for driving on a suspended license, 8 years ago he got a DUI, and driving on a revoked, and the revoked has passed since then, now he is just suspended, and he has never had a license at all...
