Speak Up! - View Question #125

    printer friendly version

Question: How old do I have to be to stop having visitation with my dad?

Answer: Generally, a parent is required to pay child support and entitled to visitation until a child is 18. However, if the court finds, after a hearing, that visitation would seriously endanger the child's physical, mental, or emotional health the court may stop visitation.

The parent who has custody of you could ask the court to appoint a lawyer for you and an Arizona law (ARS 25-321) would permit the court to do so. After doing an investigation, your lawyer could ask for a hearing on your behalf.

The fact that you may not particularly like spending time with your parent won't cut it but if your parent is really harming you in some way you definitely should let someone know.

I, TOO, HAVE A 8 YEAR OLD CHILD WHO DOES NOT WANT TO HAVE VISITATION WITH HER FATHER BECAUSE OF HIS BITTERNESS TOWARDS ME AND ALSO DUE TO THE FACT THAT HE SHOWS HER NO ATTENTION WHILE SHE IS WITH HIM. IT IS SO SAD WHEN I HAVE TO MAKE HER GO BECAUSE "HE IS HER FATHER". SHE CRIES AND BEGS TO STAY HOME. BUT THERE IS NOTHING I CAN DO BUT PRAY.

If I do not want to go see my Dad every other weekend do I have too. I know he does not hurt me but he never listens to me or understand me. He is always with my older brother fishing hunting and what ever he wants to do. I want to go out with my friend and be with them on the weekends and be a kid not over there sitting infront of the t.v. When do I get to say what I want to do. My bio Dad says I have to come but I will not go. So he tells my Mom she is in contepmt of court. But I read the Divorce and It just says 6 to 6 everyother weekend it does not say I have to go. What are my rights. KLT

I have been divorced for 11 years. My oldest son is 18 and one 16 and one 14 1/2. The 16 and the 14 year old do not want to go to there Dads, how old to they have to be before the choose. They have not gone over there in a year. He always gives them a choice and not he says they have to come. He says I am in contempt of court if I do not send them. They are not being harmed but emotional is what it is. He was physically to me. When we were married.

I have to send my children to another state and They are 9-15. They don't want to see their dad, because all he does is whin to them and stress them out and watch t.v. I dont feel they should have to go. He is a control freak and hollers about his rights but what about my children rights to have peace of mind and sanity. When I child starts smoking to get some peace that is bad.
