Question: What is the conviction for a hot check writer over $500.00?
Answer: The civil penalty for writing a bad check is twice the amount of the check or $50; whichever is greater, cost associated with a lawsuit and reasonable attorneys’ fees (which could reach thousands of dollars!).
The criminal penalty is up to six months in jail or up to $300 or both if the check was under $25.
If the check was between $25-$100, up to five years in state prison or up to one year in county jail or up to $500 fine or both.
If the check is over $100 or if no account, up to five years in a state prison.
