Question: My father wants to give up his parental rights, can he do that, and can my mom still get child support from him?
Answer: A father cannot give up his parental rights all by himself. He has a duty to support
and to "parent" his child. He can agree to allow someone else to adopt
his child if that person is willing to do so. He can lose his parental rights
if he does certain things, i.e. neglects the child, abandons it, is unable to
parent the child because he is mentally ill or in prison for a very long time,
etc.
If a person adopts the child, or if his rights are terminated, the parent no
longer is responsible for current child support. He would still have to pay
back child support, which is child support he was supposed to pay for the months
before the termination.

i have a 2 1/2 old son whose father took me to court when he was almost one to pay child support to see my son and saw him for 2 months and dropped him off to me on christmas day of 2002 and has not ever called to see my son anymore but is paying child support still. i have 2 other sons from a previous marriage who see their dad and now their dad is taking my baby with him as well and my son is calling him dad. my question is can i take my babies dad to court and make him terminate all rights so my son can move on with a man who is willing to raise him and be there as a father for him?

To Desiree: I am in pretty much the same position a little different however. My child is not born yet the father has 3 kids he doesn't take care of already and I would rather not deal with the hassle of having anything to do with him. If you get any advice please let me know. I also have noone in line to adopt nor do I want a dime from him, if I did I wouldn't get it anyway, but I want consistency in my childs life not someone who is abusive and flaky. Good luck!!!
