Speak Up! - View Question #503

    printer friendly version

Question: Are sniffing whiteout and magic markers illegal?

Answer: Inhaling toxic vapors is commonly referred to as 'Huffing' and it is against the law in Arizona.

It is against the law to knowingly breathe, inhale, or drink a vapor-releasing toxic substance. Common things that fit this definition are glue, spray paint, gasoline, etc.

There are also regulations regarding the sale of inhalants. Using or selling these substances is regarded as a class 5 felony or a class 1 misdemeanor depending on the seriousness of the offense. (ARS 13-3403).

Also see more information on this topic under substances in the LawForKids.org Laws section.

Why is it legal for four year olds to COLOR with magic markers? Honestly, what four year old is going to say, "hmmmmmmmm, maybe if i huff this ill get high and then i can have a good time." come on. the only way a four year old would do this was if an adult came and told them or forced thed to, but what adult would waste their time doing this. i severely doubt little kids are gonna try to get high.

I get high off of white out. It is as bad as smoking kokaine. I am stoping. It is bad for you. It gets you OH SO HIGH. And it is bad for you. Don't smoke it either. Lighting it on fire is worse. It mixes up your brain cells you can die its not smart.

I agree with tamara, but.. this is not smoking, this has to do with inhaling fumes, a bit different. Sort of like saying sniffing glue and cocaine are the same.. when they arent. As for the law, I'd politely call it "stupid"... I hope it isn't actually worded that I cant "knowingly breathe, inhale, or drink a vapor-releasing toxic substance" What about when im coloring with magic markers, and smell them. Is that illegal? Can you really make smelling something illegal? This is sortof borderline. If I smell someone's fart, and it makes me disoriented... is that illegal? :)
