    Question: Does a cop have to document a breathalyzer test?

    Answer: Yes, in Arizona the officer must document the test and the observation/deprivation period prior to the breath test pursuant to Arizona Department of Health Service regulations on the administration of breath tests.

    If a cop says they smell alcohol on your breath, but does not give you a breathalizer, then files a report, what do we do to show the cop was wrong? Do we have to do anything in court other than say the cop was wrong and should have given a breathalyzer test.

    i was caught in a car with three friends who had open drinks. my friends all got Minor in possession and i got a Minor in Consumption. The police officer witnessed them drinking (reason we got caught) but not me. i did admit to having one sip (i can't lie). How did i get the higher ticket and not them?
