Question: What is the penalty for assault and battery?

Answer: The laws are different in every state, but are basically a crime. Punishment usually depends on how serious it was, if a weapon was involved, was the victim physically injured, etc. In many states a juvenile accused of assault can (or must) be tried as an adult. Penalties include jail, prison, probation, fines, restitution, community service and counseling. The Judge considers the age of the person, their record and the seriousness of the crime.

About ten guys at my school, most good freinds of mine, jumped this kid and beat him up and while he was on the ground they kicked him, i dont really know his injuries but i saw his face was really bloody, but nothing serious. They are all in jail right now and have a hearing in a few days, for some of them, its there second or third offense. What is going to happen to them?

I have a long history of battery charges and I got into another fight. The last time I was in trouble for this the judge said if I did it again I would go to prison. The man I got into a fight with doesn't want to press charges, because he hit me first. I through a rock at him before he hit, but he still said he would help me out as much as he could. what should I expect when I go to court?
