Speak Up! - View Question #127

    printer friendly version

Question: At what age can you choose which parents you want to live with either?

Answer: Your adopted parents are your legal parents and have the right to make decisions on your behalf until you are 18, including where you live. This must be a difficult situation for you and the adults involved if you are now having contact with your biological parents. Depending on the circumstances of your biological parents and your age, sometimes visitation arrangements can be worked out if all parties are willing. You may want to speak to your school counselor, you may need an adult to help you work through this.

I am 16 and want to live with my mother, not my grandma. I never want to see my dad and don't want him to be able to come around. How old do I have to be to choose to live with her without having to go throught the whole lawer and court thing? I just want to be happy with her and my siblings.

My mom took a job that took her out of town alotand this traveling was going to be a 6-7 month stretch and then she would be home. So we stayed with our dad until mom got home on the weekends Mom came and talked to dad and us. He told us it would work out. Once my mom had agreed to stop child support, my dad took this and filed custody for him to have us. My brother is 16 and I am 13 and the judge wouldn't listen to us that we want to live with mom. My mom waited the 6 mo to refile and today she filed. Our lawyer is going to have us testify in the court room instead of the judges chamber.

You can choose which parent you would prefer to live with at the age of 12. You must go through the court system and give them your reason to why you would prefer living with the other parent. The judge will then decide if you have given him a just reason and will rule on where you will reside.
