Speak Up! - View Question #176

    printer friendly version

Question: I am 18 and still enrolled in high school, can my parents legally kick me out of the house?

Answer: Yes. Once you have turned 18 years old, you are legally an adult and your parents no longer have a legal obligation to care for you.

The converse is true as well: once you are 18, you have the legal ability to make decisions for yourself.

The only exception to this is if you were legally incapacitated in some way. For example, if you were judged by a court to be incapable of making decisions for yourself. In that (somewhat rare case) your parents could be appointed as guardians for you after the age of 18 and would still have to provide for you.

In response to your comment, I am fighting just the oposite, My son turns 18, his grades suck, and I'm trying to keep him at home until he graduates, WHY? Because I want him to get an education, and I fear he will drop out or fail if I'm not there to guide him in the right direction, he has never shown good common sense, he lies all the time, and when he leaves the house just to go to the bus stop, he turns into some foul mouth vendictive jerk. What do you think.

Well, lets take it to the other level. How about a 17 yr who a) is violent, mouthy, disruptive, just two weeks ago put a paint can through a window of his brothers car because he would'nt take him to the store, who's already had two serious run ins with the police, arson and theft has been to counselling, even the counsellors say he is a closed person, argumentative and a liar. we are out of options. He is disruptive to the whole house. We have tried everything we know of, and I do mean everything.

I feel for you Jessica, I have a 17 yr old. I never thought I would be a parent that would kick his child out, but I have two others and they are no problem. He on the other hand is one problem after another, and we've had him in every program available, he just doesn't want to adhere to rules and he's made it clear he wont. It's a cruel world out there and i know we've done our best. He's going to find out it's not so easy out there.

Well Melissa, I dont think that you should be making comments about people not knowing how to spell if you dont know how to spell. I notice a few things that you actually spelled wrong.

Jessica, I don't understand. Why? Are your children criminals, drug users, or they just don't study. What are they supposed to do once you kick them out of the house? How can you feel good about yourself?
