    printer friendly version

    Question: What crimes can get the death penalty?

    Answer: In Arizona the only crime that gets the death penalty is First Degree Murder.

    There are two types of first degree murder;

    1) premeditated murder, and

    2) felony murder, which is a death which occurs while the accused is committing another offense, including sexual conduct with a minor, sexual assault (rape), child molest, certain drug offenses, kidnapping, burglary, arson, robbery, escape, child abuse, unlawful flight from law enforcement. Basically if you are in the process of committing one of the above crimes, and you cause the death of a person, you are guilty of first degree murder, for which you could receive the death penalty.

    I think that the death penalty is just. If a man/woman is willing to go out and take a family apart by killing an innocent, then he is not human and therefore shouldnt have the rights of one. When a man claims he was "crazy" at the time of commiting a crime hes right..you must be crazy to kill. But thats no excuse a grown man or woman knows right from wrong and if you are going to commit an inhumane act you should receive a punishment.

    I completely agree that the insanity plee is rediculous. There is no way someone who commits a haneious crime should be able to get out of it by saying, oh I didn't know what I was doing, or Oh it's because something happened to me 20 years ago and at the time I just couldn't handle it anymore. If you do the crime, your there you know you did it. Take responsibility, you can't pay the time don't do the crime.
